Judge: Wedding Cakes are Work of Art, Protected by First Amendment

Kern County Superior Court Judge David Lampe has ruled that owner Cathy Miller can continue to refuse to make wedding cakes for same sex couples.

“The State cannot succeed on the facts presented as a matter of law. The right to freedom of speech under the First Amendment outweighs the State’s interest in ensuring a freely accessible marketplace,” Lampe wrote in his ruling on Monday. “The right of freedom of thought guaranteed by the First Amendment includes the right to speak, and the right to refrain from speaking. Sometimes the most profound protest is silence.”

The case, which has received national attention, began in August when Miller — a conservative Christian — refused to make a wedding cake for Mireya and Eileen Rodriguez-Del Rio.

Miller said it went against her Christian beliefs to make a cake for a same sex couple.

The Rodriguez-Del Rioses made a complaint to the California Department of Fair Employment and Housing that Miller had violated the Unruh Civil Rights Act.

The only reason a same sex couple would try to force someone to make their wedding cake is to start a bunch of crap. There are hundreds of other and even better places that will do it. But no, by ***, people are going to do what they say, and that person's feelings be ****ed. BTW, they won't talk about the Muslim owned shops that refuse to do it, and I don't think any of them have been sued. Typical hypocritic liberal behavior.

That's what I first thought.. Find someone else to bake your Cake. Seems in our family of in-laws, there's always 1 or 2 ladies who love to decorate and bake for Weddings/Special Occasions for Family and Friends... Apparently the Couple Couldn't find a family member or friends to step up to the plate and provide them a baked Cake to their specifications. Apparently makes one think that perhaps their family & friends may have had personal issue with the situation as well.

River, it could be that they just wanted the attention also. In this day and age it seems that everyone wants their 10 minutes of fame. It would have been easier to find a baker who would make their cake or just go with cupcakes.

 

Gifted, I disagree with lumping people together. You don't like liberals so you think they are all hypocritical. That's not the case. It's like saying all Republican's are rich and don't care about poor people or that all Democrats are for abortion.

Demmies attempt to force everyone to conform to their belief system, just like the Soviet Union or fascist states.  A non-Demmie same sex couple would have gone to another shop, or ordered a generic wedding cake.  Then, bought two brides or two grooms to top the cake. For a goat, they'd shop at a halal approved shop.

Not exactly a Republican black bloc dressed for rioting when Demmies give screeches on campus.  Nor, are there MSM that march goose lock stepped to the Demmies tune.

I see nothing in any liberal to change my mind. They are crap starters that won't tolerate people having opposing opinions so thay force theirs on the ones they know they can bully. Repeat, the ones they can bully. They are notorious liars. I notice too, that despite others on here disliking liberals, and expressing that, you choose to harp at me.

Gifted, I wasn't harping on you. I was trying to make the point that that not all liberals, Republicans, Democrats, Independents can be painted with the same brush. A lot of people on here think that every Republican, Democrat etc thinks the same way as the others in their party. They don't. I bet there are liberals that aren't hypocritical. Just like there are Repubs that want the best for the US there are Dems that want the best for the US and Liberals who want the best for our country.

As posted before, there are way to many places and people to make wedding cakes to go after someone that doesn't want to do it. Besides, wedding cakes have changed so much over the years, some don't even look like the "traditional" wedding cake anymore, and don't have a bride and groom, or other couple, on them. The only reason gays force someone to make a "wedding cake" is to force that person to go against what they believe, and bend them to their will, and it's not right to do that to others. I wouldn't have a problem making a cake for anyone, but if I did, and IF I was forced to do it, it would be the worst tasting cake they'd ever had. How about it lefties, live and let live, stop bullying people.

 Did she ask them if they were gay? What would be the point of asking a woman if she'd had an abortion? Think monkeys, think. She could say no even if she'd had 20. The couple only wanted to start crap with her, and force her to do what they want. That's why they even went there. The left is all about getting what they want, and others rights be ******. They will try to ruin a person's life if they oppose them.

I meant that it was a good point in that where do you stop, not that I think asking a woman if she had an abortion was a good thing or that a baker shouldn't make a cake for that person. I didn't realize that was a snide, sarcastic comment that person was making and I agree that snide and sarcastic comments aren't useful in making a point. Just like I don't think belittling other people and calling them names will help others see their point.

I have nothing against gays. I'd buy a cake from them. If I had a business though and the government was making me do something I truly felt was morally wrong I don't know what I would do. What would you do?
