I never could see any reason for him to be charged. Maybe this takes the teeth out of the lawsuit the woman's family has against him.

LOS ANGELES (AP) — Prosecutors declined to charge Caitlyn Jenner on Wednesday in a California car crash that led to the death of another driver, saying there was not enough evidence for a conviction.

 

Authorities said Jenner was towing an off-road vehicle on a trailer behind a Cadillac Escalade on Feb. 7 when she crashed into two cars, pushing one into oncoming traffic. Driver Kim Howe was killed when her Lexus was hit by a Hummer.

"We believed from the start that a thorough and objective investigation would clear Caitlyn of any criminal wrongdoing," said Blair Berk, Jenner's attorney. "We are heartened the district attorney has agreed that even a misdemeanor charge would be inappropriate. A traffic accident, however devastating and heartbreaking when a life is lost, is not necessarily a criminal matter."

The accident occurred before Jenner announced she is transgender and transitioned into her new identity as Caitlyn.

Sheriff's investigators previously determined that Jenner, 65, was traveling at an unsafe speed for the road conditions at the time and there was enough evidence to support a vehicular manslaughter charge. The case was then referred to the district attorney's major crimes division.

After the accident, Jenner released a statement expressing sympathy to everyone involved in the accident.

"It is a devastating tragedy," the statement read. "I cannot pretend to imagine what this family is going through at this time. I am praying for them."

Jenner is facing separate lawsuits by Howe's stepchildren and the driver of the other car involved in the collision. Jenner's lawyers are fighting efforts to have her give sworn testimony in a deposition in the wrongful death suit filed by the stepchildren.

The crash has shadowed Jenner's much-lauded transgender transition that was announced in a two-hour television special with Diane Sawyer. A Vanity Fair cover story revealed her new identity, and a reality series "I Am Cait" chronicled her new life.

In July, Jenner accepted the Arthur Ashe Courage Award at the ESPYs sports achievement event and urged fellow athletes to join her and make advocacy for transgender issues a priority.

A Los Angeles judge approved Jenner's petition to formally change her name and gender on Sept. 25. Jenner was born Bruce Jenner and won an Olympic gold medal for the decathlon in 1976.

Jenner was married to Kardashian matriarch Kris Jenner for more than 20 years and frequently appeared on "Keeping Up With the Kardashians." The couple had two children together, and Jenner has four children from previous marriages.

I saw a simulated recreation of the accident.  Apparently there was a public transit bus nearby that caught most of the action on its camera.  If what I saw was accurate, he was both speeding and following too closely; and he rear ended the car in front of him, pushing it out into the other lane, causing a head-on collision.  Sounds like vehicular manslaughter to me. 

 

If I were the family of the deceased, I'd definitely be suing for wrongful death.  His/Her prayers wouldn't be satisfactory.

Of course prosecutors declined to charge. You put enough money in the right person's hands, you can get whatever you want.

 

I agree, Crusty. I hope that family goes after him for wrongful death. One report I read was that Jenner appeared to be texting at the time of the crash. If I were that family I would be insulted that he said he was praying for them.

She didn't have kids. By all accounts a nice lady killed in an accident, and now she has 'relatives' interested in her.

 

 

Kim Howe spent her last decade alive living alone with her rescue dog Daisy in her home in Calabasas, a posh southern California enclave where she counted Jenner’s stepdaughters, Khloe and Kourtney Kardashian, as neighbors.

 Now, TMZ reports that her two grown stepchildren – Howe’s closest surviving relatives – are looking to sue Jenner for her wrongful death.

The site alleges that, although friends say they had “virtually no relationship” to Howe, both of them have sought legal counsel. The stepchildren, who don't live in California, have been advised by lawyers to gather as much evidence as possible to prove they did in fact have a relationship with Howe, 69. TMZ claims the evidence will help to build their case, proving that Howe’s death did in fact cause them damage.

According to TMZ, it is unclear what either stepchild hopes to gain from the lawsuit, as neither stands a chance of inheriting Howe’s property. The site reports she did not have any remaining close relatives as her husband died in 2003, and both her parents appear to have died years earlier. Sources revealed that, before her death, Howe set up a trust, leaving all of her assets to charity. She also had a will, which did not name either of her stepchildren as a beneficiary to her money or belongings, but rather requested that $55,000 be donated to various charities. Those charities include PETA, the Lange Foundation, PAWS, the Doris Day Animal League and the Elephant Sanctuary of Tennessee.
