The current pending hearing is the most important.  If it passes as it is expected, then they will start to progress. There is supposedly already some things in progress. The only (final) alternative after this hearing would be an appeal to the Alabama Supreme Court, which has historically ruled to stay out of these cases and always sides with the lower court decisions. Although a continuance would delay the project, it would not likely stop it, so it remains to be seen whether the powers in charge at HKH and HH will continue to deny the residents a new facility. If the lawyers have their way, they will continue to pursue it, since the only people winning in that situation will be the lawyers who continue to suck money from this shenanigan. The court of popular opinion is definitely in favor of a new facility which will bring growth to the whole area. The argument against it has o merit.  If a 360 bed hospital has not forced the closure of the other, how will a new 220 bed hospital do that? The logic is absent from the argument in all of its phases.
