"What if??" what? I don't get the point you are trying to make with that question/statement.

From reading the article, it doesn't appear to fall under the definition of "Hate Crime" - Hate crimes (also known as bias-motivated crimes) occur when a perpetrator targets a victim because of his or her perceived membership in a certain social group, usually defined by racial group, religion, sexual orientation, disability, class, ethnicity, nationality, age, gender, gender identity, or political affiliation.

Unless the cops were Duke fans and beat the dude up because he was a Maryland fan.
