This may be an interesting case.  Many state governors and the president employ a political advisor at the expense of the party or campaign fund.  Karl Rove was Bush's, for instance. If she was given no executive authority, nor directly gave instructions/orders to Alabama employees, it would be hard to prove she acted within the bounds of the audit's prohibited actions.
