Should have known?

I was seeing where the owner of the new Stricklin Hotel & Event Center has lodged a complaint against Flobama due to noise complaints that some of the guests have had, specifically noise that was happening at 2 AM for one Hotel guest.   

In this case, you have two Florence businesses, one established and the other new, that are at odds with each other.  In this case, you can feel for the owner of the Hotel who is concerned about negative reviews due to the noise level but on the other hand, Flobama has been there for a long time and surely long enough that anyone would know that they have live entertainment that stretches into the morning hours.   This isn't some new business that just moved in and set up operations and the format of there operations is the same as it's been for a long time.  Surely any prospective tenant that would locate next door to Flobama would know about the neighbor next door so would have known what the noise would be like.   

Knowing this they could have taken added precautions to beef up noise protection during construction to any rooms that would be located adjacent to the wall between the businesses and even if the noise couldn't be abated then the person would be aware that it was a potential problem for locating a Hotel room where they did.  I'm all for hoping that new businesses thrive and prosper, in our area, but it's hard to feel, in this case, that the new building owner has a valid argument.  The one exception is if Flobama is in violation of known, or should be known, noise statutes that are on the books.  If that is the case then the Hotel owner could have a valid complaint.  Personally, I don't know enough to say any more than the comment above but just hate to see two businesses, adjacent to each other, have conflicts.
