All he gets is 365 days out of school? He'll probably love that! The DA should bring charges against him. He's sadistic & a threat to any child he comes in contact with. This whole story almost smells like a cover up, one of those brush it under the rug type deals. The victim will never be the same & his abuser should be tried as an adult since he made a decision to cause harm. He should pay the consequences in prison.

So you think the DA should file charges? Read your topic to this thread!

I think there were assault charges against him before the School board considered any discipline against the youth!

 Most likely it will be presented to a grand jury which could upgrade any current charge he has now.

 Do you think he needs only punishment or is there any possibility he can be reformed? More gossip.

Looks like being expelled is the least of his worries.

 

 

KILLEN, AL (WAFF) -

One student faces felony charges and another was in the hospital after an assault at Brooks High School.

According to police, a 15-year-old student attacked a 14-year-old student in the band room during the last period of the day on Thursday.

The alleged attacker gave police a statement to police on Friday afternoon and turned himself in on Saturday to juvenile officials. The student was charged with second degree assault, which is a felony.

Under the law, it fits the criteria that he used a deadly weapon or dangerous instrument to cause serious bodily injury.

Because this case involves juveniles, names have not been released. Superintendent Jennifer Gray said the district is working closely with local police in the investigation.

"Any time something happens to one of our students, we take it very seriously. Student welfare is a top priority, so it's a good time for us to take a step back and take a look at the things we have in place and see how we can improve upon those from this point on," Gray said.

The victim was taken to ECM Hospital after the attack and has been there ever since. He's expected to be released Tuesday, and will continue his recovery at home.

Authorities said they are still working to determine a motive for the attack.

Based on the accusations we have read, the charge is Assault 2nd. It is defined, in basic terms, as causing physical injury with a deadly weapon or dangerous instrument. There are other factors that aren't applicable here. If serious physical injury, as AL law sees it, Assault 1st would be the charge. There are several things that could happen. The grand jury could upgrade it. If not, they can have a hearing before the judge to determine if the crime can be transferred to the adult courts. I'm sure their will be more developments as time passes.

I agree. 

I was told that this possibly was a case of one kid putting something in the other kid's seat as he sat down.  But then I read about the amount of treatment required, and the length of recovery expected, and I'm not sure if that's a feasible scenario.  I wonder what went into the decision not to classify this as a sexual assault?
