"Cheney's office says it is exempt from Bush's executive order because it's not an entity within the executive branch. The order, issued in March 2003, directed all agencies and executive branch offices to report on their classified and nonclassified files to the National Archives and Records Administration."

'According to a letter that the National Archives sent to your staff in June 2006, you asserted that the Office of the Vice President is not an `entity within the executive branch,' and hence is not subject to presidential executive orders,'' Waxman wrote. ``To my knowledge, this was the first time in the nearly 30-year history of the Information Security Oversight Office that a request for access to conduct a security inspection was denied by a White House office.''

Stupid me -- I always thought both the President and Vice-President were part of the executive branch of our government.

Cheney is a political snake who believes that he and those around him are not subject to ANY laws because they are all so "special". I hope Waxman and other lawmakers keep on hounding him and is able to bring to light more of this administration's abuses of power. We will never know the full extent of their dirty tricks because by now I'm sure they have destroyed much of the incriminating evidence.

They can keep hounding him, won't do any good though, just waste more of our tax dollars on a witchhunt. The vice president is NOT a member of the executive branch. You will not find anything in the Constitution or anywhere else indicating that he is. He does not report to the President and the President has no authority over him. The President cannot remove him from office or discipline him. His sole duty is to serve as the president of the Senate, except for the case of an impeachment trial, in which I believe the Chief Justice of the Supreme Court serves as the president of the Senate. The only body having authority over the vice president is the Congress and that is only in the case of his impeachment.
Hang on a sec, Aubfire. If the VP isn't part of the executive branch (and he's definitely not a part of the other two), then what branch is he part of? Or has a shadowy "fourth branch" been hiding in the constitution all these years? Pul-leeaze. Any 8th grader can see through that argument.

The VP has little Constitutional mention because the position was never meant to be more than a consolation prize for coming in 2nd. THIS vice president is the most evil in history, and he's grabbing at the thinnest of legal straws to cover up his evil.
Hmmm....On June 21, 2007, it was reported that Vice President Dick Cheney has asserted that the office of the Vice President is not part of the executive branch of the US government, and thus is not bound by presidential orders governing the protection of classified information.

It appears that based on how it complied with instructions, directives and requests relating to information, that the Vice President's office began to assert its view that it is not part of the executive branch as early as 2003.

Very interesting. I'd always assumed the office belonged to both branches, as a sort of liason. It will be interesting to see how this plays out.
NEWS FLASH... Cheney apparently still believes his office should receive funding as part of the Executive branch. This should be an interesting sequence of events:

Washington, D.C. House Democratic Caucus Chairman Rahm Emanuel
issued the following statement regarding his amendment to cut funding
for the Office of the Vice President from the bill that funds the
executive branch. The legislation -- the Financial Services and General
Government Appropriations bill -- will be considered on the floor of
the House of Representatives next week.

"The Vice President has a choice to make. If he believes his legal
case, his office has no business being funded as part of the executive
branch. However, if he demands executive branch funding he cannot
ignore executive branch rules. At the very least, the Vice President
should be consistent. This amendment will ensure that the Vice
President's funding is consistent with his legal arguments. I have
worked closely with my colleagues on this amendment and will continue
to pursue this measure in the coming days."

The Washington Post & MSNBC.com are running a series of interesting articles on Cheney and his dirty tricks:

Cheney is the epitome of a sick political animal on an ego trip who works very skillfully to implement his twisted, greedy, self-serving agenda. Neither Cheney nor his boss could care less about what is best for the American people. As stated in one of the above articles:
"The only person in Washington who cares less about his public image than David Addington is Dick Cheney," said a former White House ally. "What both of them miss is that ..... in times of war, a prerequisite for success is people having confidence in their leadership. This is the great failure of the administration -- a complete and total indifference to public opinion."
