(Reuters) - A Missouri man who ran into trouble with police when shooting his gun on his family's property and then was ordered to take a video of the incident off the Internet has won an apology from the local police chief and settled his lawsuit against the officer, the gun owner's attorneys said on Wednesday.

 

In the May 2013 incident in the southeast Missouri village of Kelso, the police chief, Jerry Bledsoe, arrived at the home of gun owner Jordan Klaffer's mother in response to a noise complaint lodged when Klaffer was target shooting.

Klaffer's video of the incident shows Bledsoe insisting that Klaffer surrender his guns or be arrested. Klaffer refused to turn over his guns and was arrested for disturbing the peace. The video shows Klaffer repeatedly asking Bledsoe to explain how he had broken the law.

The video was posted on various social media sites until Bledsoe secured a court order that forced Klaffer to remove it and any text about Bledsoe from the Internet.

The American Civil Liberties Union, which filed a lawsuit against Bledsoe in February on Klaffer's behalf, said Kelso police had agreed they would not seek to censor criticism of police actions and that Bledsoe had written a personal apology for doing so.

The ACLU said Bledsoe agreed to pay unspecified damages, court costs and attorney's fees to settle the case, which drew attention from advocates for gun rights and free speech.

In the lawsuit, Klaffer argued that Bledsoe harassed him for exercising his gun rights under the U.S. Constitution, and said his posting of the video of the officer's actions was protected free speech under the Constitution's First Amendment.

"This is an important win for First Amendment freedoms," Jeffrey Mittman, director of the ACLU of Missouri, said in a statement. "It is a reminder for all police departments that citizens have a right to record public interactions with police officers and share those recordings freely."

Bledsoe declined to comment. His attorney, Keith Henson, said that although Bledsoe apologized, there was no admission of liability or wrongdoing.

"Captain Bledsoe never intended to violate Mr. Klaffer’s constitutional rights, but simply was trying to protect his rights," Henson said.

How is that?  Dont usually see LEO's against law abiding gun owners.  Weird comment - I'm protecting your rights by violating them....

 

My dad open carries every day.  Long haired hippie type, looks strange with a gun on his hip while walking with his cane  He was in Walmart the other day talking to someone about what type of pistol he carries.  A third guy in the hunting department said 'I carry as well, but I have a badge at home to go with mine' (apparently he is a retired LEO.)  Dad looked him straight in the eye and said 'and I have a second amendment to go with mine.'  The guy replied 'ohh, you're that kind of person' to which dad said 'Yep.' 

 

I don't open carry often, but I'm that type of person as well and proud of it.  I gave six years of my life defending the freedoms so many here either care nothing about or are unappreciative of.  Its sickening sometimes to watch......

BTW - before someone criticizes an old cripple man for carrying a gun (cause I am sure there are many here who will) - dad walks with a cane because he had a heat stroke while riding one of those two wheeled devils chariots that RP loves so much and nearly lost his leg in the wreck that followed.  I assure you his draw hand suffers no such disability.  It is difficult for him to concealed carry in the summer, though, because an 'in the pants' holster bothers his artificial hip and makes it more difficult for him to walk......

cap, you made that story up. I carry a 9mm glock in knit shorts without a problem. who wants to wear a dern pistol belt and holster other than to look stupid.  you gun nuts would be the first target if a bad guy comes in and sees your open carry. ...I can shoot without removing it from my pocket and not at my foot either.

You mispelled a word.  The "gl" should have been just a "c" in your case.

Next community elections, removing Bledsoe from the police department should be an item.

While I support open carry, I know that doing so causes some to feel uncomfortable.  This conflicts what I was taught -- that a gentleman makes others comfortable, If possible. Therefore, I will carry concealed with a license.  However, I will support those who carry openly.

I open carry sometimes when I ride four wheelers, most other times I carry concealed.  QD actually has something right (even a blind squirrel finds a nut from time to time), open carry can take away the element of surprise.

A couple of months ago at Sam's I walked in behind a fellow open carrying a sidearm in a belt holster. Instead of watching him, I was more curious about how other people would react. It seemed that most people were oblivious to the fact there he was packing a pistol. It seems most modern folks aren't too observant; I guess sometimes its best to hide things in plain sight.

Yes, tactical always taught us to shoot the man with the most dangerous weapon, first.  IOW, bad guy will shoot the open carry guy first.
