There is nothing in what the Mayor of Houston is doing that would prevent the preachers of Houston from preaching against homosexuality or penalize them for doing so.. The issue she and her lawyers are raising is the question of how those preachers might have instructed their congregations concerning a petition circulated in opposition to the Houston Equal Rights Amendment.
How that petition was handled--or mishandled--by the city is the subject of litigation against the city and since the preachers were much involved in its promotion, the Mayor seems to think she can fain some kind of fault with them by showing what they said and did to promote the petition.
Her subpoena (which I have read) is overly broad, which she now has grudgingly admitted, and it has been amended. I have not seen the revised subpoena, so I can not comment on that.
The First Amendment is not in any jeopardy in this case. The five preachers to whom the subpoenas were served and any other preachers in Houston who wish to do so can preach against homosexuality, abortion, gambling, adultery, drunkenness, ****ography, immodest dress, or a plenitude of other societal evils without having their freedom of speech restrained by any action the lesbian Mayor of Houston has taken.
