I haven't been to a movie theater in ages but the last time I did go, I remember seeing annoying people on their cell phones. The following story is a bit extreme but perhaps people will think twice before opening that stupid phone in the theater!

When I go to some type of function, I try to remember to put my phone on vibrate.  Recently, at a session, I forgot.  My phone,coat and cap were all on a chair.  The phone rang, I picked it up, turned it off and said it'll keep.  Everyone looked at me like I was crazy.  A few sessions later, a phone rang, an eldery lady ran to her purse and began looking for her phone.  She then realized it wasn't her purse, got to her purse,got the phone and ran down the hall to take the call.  What is wrong with the general population and cell phones?  They act like the world will end if a call is missed or delayed.

It's generally inconsiderate to use your phone in a theater but in this instance, the guy was just sending a text to his daughter during one of the previews. Sounds like to me that the guy wasn't doing any harm, especially if he had his screen dimmed. The shooter was simply trying to bully people around and he didn't like it that the guy stood up to him. If he had an issue with the guy sending a text then he should have presented his objection to theater personnel. I do hope that the courts make a good example of this guy and lock him up for a long time.

If that defense is used, the court would surely be required to take into account the fact that the shooter is a highly-experienced former law enforcement officer and should have sense enough to know that being hit by a thrown bag of popcorn hardly constitutes a reason to fear for one's life.
