This is total BS, so since the kid he sexually abused was 13, I am supposed to feel better about him being around my kids who are under 13! I don't think so.

Eeker Don't be fooled by these people's actions. They are looking for opportunities. Patience is their trademark and they will strike again. Be Cautious and alert, not necessarily paranoid, but be cautious. If you take the time to read information (factual) you can understand a litle about how they operate. They do not get CURED!
I don't get it. The article says they can go to a party at Chuck E. Cheese as long as they only get there the minute it starts and leave the minute it ends. Who's there to babysit them DURING the party while they're in there mentally molesting all the children and possibly picking a victim for later? Let me see if this is right. An adult may not purchase or use an adult toy in Alabama, but a child molester can attend a birthday party at Chuck E. Cheese as long as he doesn't loiter before or afterwards. Therefore, in the state of Alabama, you can only indulge your sexual perversions if you're a child molester. Roll Eyes

I don't have any kids yet but I do have a 2 year old niece who I would protect with my life if need be. She loves Chuck E Cheese. It is all she talks about and loves to go there and play and ride the little rides. I honestly think she'd stay there all day if you'd let her. Smiler It makes me sick to my stomach to think some predator may be casing out the place for his next victim. Sick just sick.

Under the law, he's not technically a "child molester."

Ala.Code 1975 § 15-20-21. Definitions.


For purposes of this article, the following words shall have the following meanings:

(1) Adult criminal sex offender. A person convicted of a criminal sex offense, including a person who has pleaded nolo contendere to a criminal sex offense, regardless of whether adjudication was withheld.

...

(5) Criminal sex offense involving a child. A conviction for any criminal sex offense in which the victim was a child under the age of 12 and any offense involving child pornography.

Here's the statute that the article refers to:

Ala.Code 1975 § 15-20-26. Adult criminal sex offender -- Prohibited residence locations, etc.

...

(f) No adult criminal sex offender, after having been convicted of a criminal sex offense involving a child, shall loiter on or within 500 feet of any property on which there is a school, child care facility, playground, park, athletic field or facility, school bus stop, or any other business or facility having a principal purpose of caring for, educating, or entertaining minors. Under this subsection, loiter means to enter or remain on property while having no legitimate purpose therefor or, if a legitimate purpose exists, remaining on that property beyond the time necessary to fulfill that purpose. An offender does not violate this subsection unless he or she has first been asked to leave a prohibited location by a person authorized to exclude the offender from the premises. An authorized person includes, but is not limited to, any law enforcement officer, any owner or manager of the premises, a principal or teacher if the premises is a school or child care facility, or a coach if the premises is an athletic field or facility.

Unless the state could prove that the primary purpose of Chuck E. Cheese is for the entertainment of minors, it's not illegal for him to be there regardless. Of course I realize that even though it's technically a pizza restaurant it wouldn't be a stretch to say entertainment of minors is the primary purpose--especially since their pizza is horrible. I'm not taking up for the guy but it seems like the article is right. He didn't do anything illegal. And contrary to the quoted post, perverted thoughts and "possibly picking a victim for later" are not crimes yet.

And for what it's worth, it's not illegal to possess or use an adult toy in Alabama. It's just illegal to sell them.

I'm with you, Attic! But get this: a woman in Florida found that her husband led a very "dark" secret life. Though no images of little children were found on his computer, she found chats where he and other men and women would sexually fantasize about 6 year old little boys and girls. Guess what she was told? "Fantasizing is not a crime." Obviously she left him but can get NO ONE in authority to do anything.
One of his kids is very talented and attends voice lessons with a local music teacher and he attends a lot of the recitals etc. We are very aware of where he is with our kids regardless of how old his victim(s) were. While I'm sure it is very hard on him -- he did this to himself and will have to live with those consequences and questions and reactions and that serves him right. I still commend the CEC employee for their attentiveness and as much as I hate to say the cops did all they could do. Kudos to those for doing their jobs!
