Immigrants who fled after law took effect returning despite crackdown

BIRMINGHAM (AP) — Ana Jimenez and her husband were so terrified of being sent back to their native Mexico when Alabama's tough crackdown on illegal immigrants took effect that they fled more than 2,000 miles to Los Angeles, cramming into a two-bedroom apartment with more than 20 other relatives.

Now they are among the families coming back to cities like Birmingham, as the mass deportations never materialized and courts blocked parts of the law. No one knows how many people initially left the state, so it's impossible to say how many have returned. But some illegal immigrants are trickling back, unable to find work elsewhere and missing the place that had been home for years.

Of 18 Hispanic immigrants interviewed by The Associated Press in the Birmingham area, six said they had friends or relatives who had returned to Alabama after fleeing because of the law.

As for Jimenez, she left Birmingham with her husband, father and brother three days after the law took effect. Now, all except her brother are back. Jimenez said through a translator that not much had changed, though she can't reclaim her job at a McDonald's restaurant because managers are checking citizenship papers.

"Everything is the same. I just can't work now," Jimenez said through a translator. She said the family is living off the income of her husband, who installs carpet and flooring.

When she worked previously at McDonalds, how was McDonalds sending the 15.30 % FICA. 7.65% from her check and the matching employers 7.65% required by Federal Law ?

Prior to NFTA all employers were furnished a Employers Handbook with a photo of the workers employee ID and legal workers card and told the employer as an American Employer it was your duty as the employer to make sure the person had all the necessary documentation as required and displayed in the section under the employees country of origin. If the employer hired an illegal worker it was punishable by up to $20,000 and up to 2 years jail time per incident.

That's all it would take, a fine and jail time to the employer and with a little enforcement, the illegals would be back at home trying to improve their own country if that's their intent.

How are they taking out taxes on him?? One of the ones interviewed said, again through a translator, that they sold their house. How do you finance a house when you're illegal and not showing income? Plenty of questions that need to be answered.

Seeweed, in the 90's there were 1-800 numbers that would get you a legal NFTA immigrate for just under $100 this included transportation and documentation and in most cases within 48-72 hours. They were allowed to stay 24months once in their lifetime. After the Emilio Cuban ordeal Janet Reno And Slick Willie sent out a statement from the US Justice Dept that only convicted felons would be deported, little has change on deportation. 

The carpet layers, roofers, brick mason, and Ag workers are getting paid cash, with no hold outs for taxes etc. Homes usually old & small or trailers are bought as are autos for cash.

The employers are in many cases cheating the illegal. Remember they often lived in a tin roofed cardboard walled shanty, and earned between .30- .90 cents an hour with sometimes 60 hrs a week no benefits what so ever. walked to work in their homeland. So free healthcare, free school, including free breakfast, and lunch for your children plus a 40 hr work week and couple hundred dollars and a old single wide trailer to live in, this is like heaven compared to what they often left.  

Many of the farms they work on let them live as sharecroppers did in the 1950s, they live on the farm in an old sharecroppers home the farm owner gives them credit at a store he or a friend owns and pays them $100 or so a week loans them another $10-$20 per week which he doesn't expect back, just uses it to hold over them. and bring them a case of beer or a bottle of tequila on the week-end, stays for a drink or two like they are friends all the while treating them just a little better than slave labor. But that's just a little of the side do-gooders never see.  

Not every McDonald's employee is on the front, she may very well have been a cook, cleaning lady, etc. Next time you go to McDs just look at how they ring up your order, the register has symbols and pictographs not numbers, it's programmed with software sent in from corporate, with all the specials and pricing. The cashier touches the symbols, hits total, then the amount of money you gave them and the change is given, your order is then displayed on a screen for the prepares and cleared as it is placed on the tray or in the sack. It's as foolproof as possible.

You make a good point. I imagine that living here is indeed like heaven considering where they're coming from and what they're used to.

How do you get a job at Mc Donald's without a social security number?

They INS once found I think the number was 168 employees with the same SSN in one local business.  Now try to but that in your computer and tell us that any business software wouldn't kick it back out.

The employer is the person that's profiting from the most this, and the one who cries the loudest when someone mentions deporting these people. Most of the local businesses have replaced these workers several months ago. Jimmy Dean had hundreds, but when Sara Lee bought the business they checked their employees and replaced the known illegals. Golden Poultry was the main employer in Franklin Co but I hear Puritan Pride was making an effort to replace their illegals also.

We pay the contractor $10,000 for a garage he deposits it and takes out $3000 in cash and pays his illegal employees. If the contractor was $1500 under everyone else's bid you feel we got a bargain and don't say anything about his employees since they built what we wanted. but the contractor may have made $2500 more on the job than those others who bid with legal workers paying taxes and SSI and medicare. But we got a $1500 saving from your point of view so we turn our head to the illegal part and justify it as the contractor was the one cheating his help and the government.

Selective enforcement is how we got to where we are today.

It violates Federal law to refuse medical care to illegals if the medical facility receives Federal funds or to report their illegal status. This is why private health providers stabilize the patients and send them to a federal funded provider. Now you understand Russellville's closing of their maternity & delivery service. They could not refuse the service to illegals if the service was available to anyone else, so dropping the service was the only way to stop the free service, as illegals they don't have medicare or medicaid so the hospital could not get paid or refuse the service as long as it was available to paying patients.

As long as there's money to be made off the backs of the illegals and no enforcement of the immigration laws, the illegals will be here.  

e-verify will keep the better jobs from the illegals.

The highest group of un-employed is young black males with limited education, guess who has their job ? Low skill masonry work, Ag workers, common labor, poultry houses, day labor, etc.all this work was being accomplished before NAFTA by Americans.

The capitalist liberals hate, are now making more off the backs of illegals and the tax base is being cheated, but the libs don't want the illegals sent home, imagine that.

We filled out the "new hire" forms. I was pointing out that is just one other "law" people break when they hire illegals. It is beyond me why people continue to do business with companies that use illegals. Funny isn't it, how they claim the illegals are treated so badly by employers, yet they fight to keep them here, keep them employed, and employ them themselves. 

Can states pass laws punishing employers who hire illegals?  Nothing too serious, at first, perhaps a $100 fine for the first offense, $250 fine and mandatory 48 hours in jail for the second offense, then $1,000 fine and one week in jail for third and subsequent offenses. That way, a person who unknowing hired the first time, or even second time would received a minimum sentence, but serious enough to cause them to not re-offend. 

Interventor. the fine would need to be for each employee and jail time although costly for the tax payer is the only deterrent, when the violator is making big money.

An acquaintance several years back, sold to local restaurants, 1500 pounds of tomatoes each week for cash and used a senior citizen and two high school boys to harvest all of them. this was just one of many crops from 180 acre farm. never more than 5 people worked on the farm. He told me over $7000 was made per acre of blueberries which are perennials, so once successful growth is begun they require little maintenance, just harvest.

So as when the moonshiner was fined $1000, he just smiled at the judge unsnapped the bib of his overalls and said: " No problem, I got that right here" as he retrieved the wad of cash, the infuriated judge ask him to look back in his bib pocket to see if it also contained 6 months jail time, because that's what was being given to go with the fine !

If the law was enforced it wouldn't take long till the employers would be contacting the State of Alabama Employment agency for legal employees and the state would cut off the unemployment compensation benefit solving several problems.

They still have to speak English to understand the customer's order to start with.

Infomercial, a picture of a Bic Mac looks the same in Spanish as it does in English, you place the order and several others see the pictograph and prepare and deliver it from what is displayed on the screens in front of them. They don't holler back and forth with the kitchen, this is Mickey D's not Flo and Carl at the Truck Stop !!!!
