Robinson, 37, of Morganton will face charges, but the specific charges are not yet determined. Troopers say they want to meet with the DA early next week to determine exactly what charges will be filed.

Troopers say Robinson's Ford F-150 left the road in the construction zone and the workers were injured.

According to First Sergeant Brian Joines, the third worker was hit by debris and should be okay.

"This is an incident where, late at night like this, more of unfortunate inattention than something we can enforce out here to protect our guys out here," Joines told WBTV, a television station in Charlotte. 

The driver was still at the scene when WBTV arrived and troopers say the driver didn't have any signs of impairment. A blood test is being performed on the driver, which is protocol.

A trooper on scene told WBTV he believes the driver fell asleep, but that is still under investigation.

Troopers will work with the District Attorney to establish what charges, if any, will be filed.

Joines says troopers have been strictly enforcing the law in the work zone while construction was taking place. He referenced one trooper who wrote as many as 100 tickets for speeding in one week.

"We have not had an incident, in this work zone, and unfortunately right here at close to the end of it this is probably the worst one we've had so far," Joines said.
